Is CBD hemp flower legal?

Yes — CBD flower is fully legal nationwide as long as it contains under 0.3% THC (Delta-9 tetrahydrocannabinol) by dry weight. You can thank 2018’s Federal Farm Bill for hemp’s legality. This bill legalized hemp cultivation, processing, distribution, sale, and transport.

Those who smoke legal hemp flower may also encounter blind spots when it comes to drug testing. That’s because the initial “point of care” tests use antibodies that can confuse CBD and other cannabinoids for THC. This type of false positive is rare, but it does happen. If you’re going to smoke hemp regularly, we’d recommend that you let your employer know first. And don’t be too concerned. A false positive can always be corrected by confirmation testing that distinguishes between THC and CBD.

Interestingly enough, Delta-9 THC is the only hemp-derived cannabinoid that’s illegal. How much CBD is safe to take?

Research suggests that taking 300 milligrams of CBD daily by mouth is safe for most adults. This type of dosing can be continued for up to 6 months (there is less research available that has focused on the effects of taking it for longer).

Some adults can take even higher doses for a shorter duration if they are using it to control more serious symptoms. Few other substances — even natural substances — have such a large “buffer” between the right dose and a dangerous dose. In fact, CBD is virtually impossible to overdose on.

To prevent potential side effects, it’s generally recommended that you start with a low dose. You can gradually increase dosing as needed by taking about 25 to 50% more each week. It’s best to discuss taking high doses with your doctor first, especially if you plan on continuing use for many months. Before giving CBD to a child, we also recommend getting your healthcare provider’s advice and discussing the pros and cons.

Disclaimer: It is still not entirely known if CBD is safe to use if you are pregnant or breastfeeding. Because existing studies have excluded pregnant and nursing women, experts recommend erring on the side of caution in these situations until we know more.
