Both HB 532 and SB 247 allowed Virginian farmers to cultivate hemp without relying on a university’s backing. These laws reiterated the state’s definition of hemp as a Cannabis sativa variant with ≤ 0.3 percent THC. 

Like the 2018 US Farm Bill, Virginia’s new hemp statutes allowed the sale and use of hemp-derived goods. This means all high-CBD products are legal for recreational use. 

Two years after passing these hemp laws, Virginia allowed patients with qualifying conditions to apply for a medical marijuana card. Anyone who has a doctor’s approval could submit an MMJ application on the Virginia Department of Health Professions’ website. There are now a handful of medical dispensaries in Virginia where patients could buy medical-grade cannabis.

In 2020, VA lawmakers also introduced decriminalization laws for adults with less than one ounce of weed. Today, if VA police catch residents with this amount of cannabis, they will only face a $25 fine for a first offense. 

Most recently, lawmakers in Richmond passed laws that would legalize recreational adult-use cannabis by 2024. If this bill becomes law, adults could soon purchase up to one ounce of cannabis flower per day from state-approved dispensaries.
